Terms and Condition

#Based on results obtained from study conducted by market research company NuanceTree, as commissioned by SmarTone. 3,942 post-paid SIM card users were interviewed via online survey and street interviews between January and December 2022.

Monthly fee HK$109/ HK$129/ HK$159 is based on the original monthly fee HK$138/ HK$168/ HK$208 for 5G Student Plan, after a rebate of HK$29/ HK$39/ HK$49 per month credited to the customer during the contract period. After expiry of the contract, the customer will be charged at the prevailing comparable plan if the customer continues to use the service.

Welcome Offer: Customers can enjoy HK$1,200 Handset & Accessory Voucher Offer for designated handset and accessory purchase upon subscription of a designated 5G service plan under fixed-term contract. Price HK$1,599 is based on customers can enjoy HK$1,200 Handset & Accessory Voucher Offer and purchase iPad (A16) Wi-Fi 128GB (Recommended Retail Price: HK$2,799). Price HK$649 is based on customers can enjoy HK$1,200 Handset & Accessory Voucher Offer and purchase AirPods Pro 3 (Recommended Retail Price: HK$1,849). The offer cannot be used in conjunction with Extra HK$720 monthly fee rebate offer.

The free 4GB/3GB Mainland China & Macau Data Service is calculated based on the original monthly fee HK$118/ HK$88, after a rebate of HK$118/ HK$88 per month has been given to the customer within contract period.

Thereafter charge for local data HK$30/5GB or HK$60/5G Unlimited Data (data speed up to 1Mbps) will be charged on 'Advise and Consent' basis. 'Advise and Consent' basis: At any time when the local data usage on a plan nearly reaches the monthly allowance, an SMS notification will be sent to the customer. The customer may reply to the SMS to purchase a top-up that will be valid until the end of this bill month. If no top-up is purchased, data service will be suspended when the data usage has reached the allowance. Customer may purchase a top-up at any time to resume service, or wait until the beginning of the next bill month to commence service again with the new monthly data allowance. (if applicable)

Administration Fee Waiver Offer: Customer can enjoy Administration Fee Waiver offer starting from the first bill month within the contract period; the period between service activation day and first bill day will be charged on a pro-rate basis based on the original charge. Administration Fee Waiver offer is calculated based on the original HK$18 per month, after a rebate of HK$18 per month has been given to the customer within the contract period. At the end of the rebate period, the customer will be charged at the prevailing Administration Fee if the customer continues to use the service.

Other services included: 500 Intra SMS, voicemail, call forwarding, caller number display, call waiting and conference call.

The unlimited data usage under "Anytime Music" is only applicable to the local data usage incurred by listening to music within the designated music streaming apps on smartphone. Data usage incurred by apps download, software update, account registration and login, advertisement, upload, download and live video, non-music contents (including but not limited to the text, images, header files, app analytics, using in- app location based features, and any video/music streamed over VPN) within the designated apps are excluded. When the monthly local data allowance of the plan has been fully consumed and the data service is suspended, the "Anytime Music" service will also be suspended until next bill month and will only be resumed once the customer purchases data top-up options.

Anytime Music Service Rebate: Subscription to Anytime Music is required within the contract period. Customer can enjoy a monthly rebate for Anytime Music under a designated Plan, the amount of rebate is based on the monthly service charge at the time of service subscription. The rebate on the first bill month and/or the last bill month will be credited on a pro-rate basis based on the number of days of usage during the bill cycle (If applicable). The rebate amount in a bill month will not be greater than the monthly service charge. At the end of the rebate period, the prevailing comparable service will be charged if the customer continues to use the service.

5G Subscription Offer:

  • An advance payment of monthly fee and admin fee are required. The number of months of an advance payment, the extra data and/or free offers and/or the value of the premium depend on the contract subscription selected.
  • Each new customer will only be entitled to any welcome subscription offer once only.
  • Each designated contract subscription is entitled to the above offer once only. The Company reserves the right to offer an alternative gift of equivalent or approximate value. This offer cannot be used in conjunction with other subscription / re-contract offers.
  • The above offers will be forfeited if the customer changes to other service plans, and the Company has the right to charge the full amount of the gift without prior notice.

Undergrad 5G Plan

  • Applicant must be aged 18 or above and a full-time student of designated post-secondary education institutions in Hong Kong. Designated post-secondary education institutions in Hong Kong include accredited universities in Hong Kong, Caritas Institute of Higher Education, Caritas Bianchi College of Careers, Centennial College, Chu Hai College of High Education, Gratia Christian College, Hang Seng University of Hong Kong, HKCT Institute of Higher Education, Hong Kong College of Technology, HKU SPACE, Hong Kong Nang Yan College of Higher Education, Tung Wah College, Vocational Training Council or Hong Kong Academy for Performing Arts. Also applicable to applicant aged 18 to 25 with valid overseas post-secondary education institutions student ID card. Valid student ID card and identity document must be presented upon registration for the Student Plan. Each identity document can only subscribe to the Student Plan once.
  • An admin fee of HK$18/month and a fixed term contract are required. (if applicable)
  • Call duration is rounded up to full charge units for computation purposes. Each full charge unit is based on a per minute airtime charge.
  • Intra SMS is text SMS sent within Hong Kong to SmarTone customers and is subject to a monthly quota of 500 Intra SMS units ("Quota"). If the usage exceeds the Quota, the thereafter charge is HK$0.3 per Intra SMS; charge per Inter-network SMS is HK$0.6. Each SMS is calculated on 160 English characters or 70 Chinese characters basis. If your message exceeds this limitation, it will be transmitted in form of multiple SMS.
  • Roaming charge & standard roaming data charge apply when roaming. Please ask our store assistants or visit our website for details.
  • 5G service plans are not applicable to 2G phones/ connected devices or any phones/ connected devices which have manually opted for 2G network. If the customer uses this plan on any 2G phones/ connected devices or any phones/ connected devices which have manually opted for 2G network, any charges which may incur will be borne by the customer. Actual data transmission speeds may vary due to Internet traffic conditions, local conditions, hardware, software and other conditions which may arise.
  • Plans cannot be used in conjunction with DataRoam Plan.

Free 4GB per month Mainland & Macau Roaming Data Pack:

  • The Free 4GB per month Mainland & Macau Roaming Data Pack ("the Package") is calculated based on the original monthly fee HK$118, after a rebate of HK$118 per month has been given to the customer within contract period. The monthly 4GB data allowance of the Package can be used in Mainland and Macau and only available for existing customers of the Company's designated monthly mobile service plan. Customers should activate "Data Roaming Day Pass" at the same time. When the Customer is located in Mainland and Macau and the data usage has exceeded the monthly allowance of the Package, the Company will notify the Customer by SMS. The Customer may reply by SMS to purchase a top-up of the Package at the charge as specified in the SMS received. If the Customer does not reply to top-up, any subsequent data roaming usage will be deducted from other roaming products. If no other product is available, customers will be charged at a fixed daily rate automatically.

Free 3GB per month Mainland & Macau Roaming Data Pack:

  • The Free 3GB per month Mainland & Macau Roaming Data Pack ("the Package") is calculated based on the original monthly fee HK$88, after a rebate of HK$88 per month has been given to the customer within contract period. The monthly 3GB data allowance of the Package can be used in Mainland and Macau and only available for existing customers of the Company's designated monthly mobile service plan. Customers should activate "Data Roaming Day Pass" at the same time. When the Customer is located in Mainland and Macau and the data usage has exceeded the monthly allowance of the Package, the Company will notify the Customer by SMS. Anytime Music Service:

  • Only applicable to customer who has subscribed to the designated Student Plan.
  • Customer opting for "Anytime Music" service, the contract end date will be the same as the designated Student Plan. (if applicable)
  • The available designated music streaming apps will be updated and amended from time to time. Please ask our store assistants or visit the Company website for details.
  • The designated music streaming apps are provided by a third supplier. The content and the settings of those apps may change from time to time without any notice. The Company makes no representation or guarantee as to the quality and availability of the services or information provided by the third suppliers.
  • Subject to relevant terms and conditions. Please refer to T&C-T316 for details.

HK$1,200 Handset & Accessory Voucher:

  • Customers can enjoy Handset and Accessories Discount Offer for designated handset and accessory purchase upon subscription of a designated 5G service plan under fixed-term contract. The amount of the discount offer to be given will depend on the contract subscription selected by the customer. Customer is required to purchase designated handset and accessory at the prevailing Recommended Retail Price at the Company's stores. A prepayment of designated amount of service fee is required (If applicable). Prepayment amount depends on the service plan selected. The prepayment amount will be credited to the customer according to the rebate arrangement specified in the Sales and Services Agreement (or Supplemental Agreement to the Sales and Services Agreement) upon the activation. The prepayment amount will be credited to customer’s bank account via Faster Payment System (FPS) or will be credited to customers' monthly bill and the mobile services plan must be still activated. Customers must ensure the accuracy and completeness of the FPS information provided (If applicable). The rebate method depends on customers' selection. The offer is valid for 180 days from the date of contract subscription or the date of contract renewal acceptance. Customer can use the discount offer for one transaction only and can enjoy 12 months' Upgraded Back-to-Front “SmarTone Screen Replace™” for free upon designated handset purchase.

Upgraded Back-to-Front SmarTone Screen Replace™:

  • marTone Screen Replace™ is provided by Avo Insurance Company Limited and Sun Hung Kai Properties Insurance Limited (collectively "Avo").
  • Upon accidental physical damage of the designated Smartphone/Wearable devices screen and/or its back cover, Avo will reimburse the cost of screen/ back cover repair or replacement, once only within the first 12 months from the effective date of Screen Replace. The reimbursement is subject to submission by the customer of the official invoice (must include the IMEI number of the device) from the manufacturer or its authorised repair centres as stipulated by Avo. The maximum amount of the smartphone reimbursement is HK$3,000 per claim. The maximum amount of the wearable device reimbursement is HK$1,500 per claim.
  • The reimbursement is restricted to covering the repair or replacement cost of accidental physical damage of the designated handset/Wearable devices screen as well as back cover, and expressly excludes any other repair and refurbishment of any other component or the handset itself. If the manufacturer or its authorised repair centres, as stipulated by AVO, offer a replacement as the only option for repair, Avo may exercise discretion and will reimburse up to 60% on the cost of replacement, subject to the maximum limit per device. The reimbursement percentage can vary from time to time and Avo's decision on the validity for reimbursement is absolute and final.

Disney+:

  • This Service is only available for SmarTone Customers with an active monthly mobile service plan subscription and Home 5G Broadband monthly service plan subscription.
  • Upon the expiry of the contract, the customer will be charged at the prevailing retail price of the service if the customer continues to use the service. Customer shall not be entitled to the rebate amount or any balance thereof if change to other service/ cancel this service. The rebate amount cannot be exchanged for cash. Monthly fee rebate offer cannot be used in conjunction with other offers.
  • Customer will receive an email or SMS notification about Disney+ service activation on the effective date of the Service. To activate Disney+ service, Customer must complete the activation by creating a Disney+ account (or log into an existing Disney+ account (if applicable)) and entering required information at Disney+ website through the designated activation link provided by SmarTone per instruction stated in the notification.
  • The Disney+ service must be used with supported devices such as compatible mobile devices that operate on the iOS or Android mobile operating systems and their designated software versions, or other compatible operating environments. If an Android mobile device does not support Google Play services, Customer may not be able to use the Disney+ App to access the Disney+ service. The compatible mobile operating systems and their designated software versions for applicable mobile devices will be updated and changed from time to time; for details, please visit Disney+'s Help Centre.
  • If Customer has an existing Disney+ account, Customer can link to it during Disney+ service activation. To avoid duplicated or unintended subscription and charge, Customer must review / manage subscription on the 'Account' page under the Disney+ account. For any queries regarding billing with Disney+ for the existing Disney+ account, please contact Disney+ customer service directly. If Customer has an existing Disney+ subscription through a third party, he / she must manage that subscription directly via such third party. SmarTone shall in no event be responsible to give any prior reminder in this respect nor be liable for any Customer's failure to timely and properly review or manage their Disney+ subscription.
  • If Customer has a Disney+ Extra Member Add-on with The Walt Disney Company (Hong Kong) Limited, The Walt Disney Company (Hong Kong) Limited will continue to bill the Customer on the Extra Member Add-on and give the Customer access to the Extra Member Add-on until cancelled.
  • Disney+ is a digital entertainment subscription service provided and operated by The Walt Disney Company (Hong Kong) Limited.
  • Subject to relevant terms and conditions. Please refer to T&C-V162 for details.

Extra HK$720 monthly fee rebate on designated Mobile plan:

  • Customer subscribes to designated Home 5G Broadband service plan at the same time and activate the designated new mobile service within 180 days upon the contract subscription, these customers of the designated mobile plan can enjoy an extra monthly fee rebate offer within contract period, total Credit Amount: HK$720, over 24 months (HK$30 x 24 months), and will be activated automatically upon service activation and after the end of the Home 5G Broadband 7-day Trial & Return Guarantee period. If (i) the customer fails to successfully subscribe to the designated mobile service plan; (ii) customer terminates the designated mobile service plan before service activation; (iii) customer fails to activate the service of the designated mobile service plan within 180 days upon the contract subscription; or (iv) the Home 5G Broadband service plan is cancelled before the contract period for any reason starting from the date of signing the contract; customer can no longer enjoy the extra monthly fee rebate offer on the designated mobile plan. Total rebate or the remaining rebate will be forfeited. Any rebate amount or remaining balance shall be automatically forfeited. Under no circumstances shall the customer be entitled to exchange for cash or refund.
  • The rebate offer cannot be used in conjunction with HK$1,200 Handset & Accessory Voucher offer.

SmarTone Plus membership & privilege:

  • Customers who subscribe or renew designated mobile service plan will enjoy SmarTone Plus membership and the membership offered depends on the service plan selected. Membership period of designated membership tier will be 13 months.
  • For members who have met the qualifying spending level during the eligible spending period, their membership will be renewed or upgraded.
  • Fixed-term contract is required for designated membership tier.
  • The Company may terminate or change the terms and conditions of SmarTone Plus at any time without prior notice.

Home 5G Broadband service plan:

^ This plan includes 200GB of data usage. When the monthly data usage exceeds the above usage, customers can continue to use data service to the next bill date, but access to network resources will be given a lower priority and data service experience may be affected.

The provision of the service is subject to the network coverage of the Company. In case particular spots where the 5G network are not available, we will continue to provide the service through 4G network. Internet experience can vary due to factors such as the relative position between user and the base stations, the download server resources, Internet traffic conditions, the number of users, users’ devices and other factors that may arise. Wi-Fi coverage depends on factors such as area & layout of the premises, construction materials, and other extraneous factors.

Offer valid for limited period only. Offer is appliable for customers who subscribe the designated SmarTone Home 5G Broadband service plan at a designated residential address for 24-month fix term contract subscription. Applicant must be aged 18 or above and a full-time student of designated post-secondary education institutions in Hong Kong. This service plan includes a HK$65 monthly rental fee for router rental service waived within the committed contract period. Customers are required to make a deposit of HK$1,500 for router rental service. Deposit of rental router will be fully refunded upon return of the router in good workable condition and can be waived if customers choose to settle the monthly fee with autopay. Upon the expiry of the committed contract period, the Customer will be charged at the prevailing plan price on monthly basis (inclusive of router rental fee(s) if any) if the customer continues to use the service. Customer who registers for the services for the first time is entitled to a 7-day Trial & Return Guarantee period commencing from the activation date of the designated service plan. If the Customer cancels the service plan within the 7-day Trial & Return Guarantee period, any other service plan(s) or value-added service(s) or related special offer subscribed together on the same application will also be cancelled and the Customer is not required to pay the monthly fee for the service and 5G Broadband service equipment rental and refund of fee paid by customer for purchasing 5G Broadband service equipment shall be arranged upon return of the 5G Broadband service equipment to the Company.
